Terms and Conditions

Your booking with Simply Swing is conditional on you accepting our terms.  If you do not agree with any part of them, you must not proceed with your booking.  If there is any part that you do not fully understand, or if you have a query about your booking, please contact us on 0845 094 8693.

Definitions

Simply Swing means Simply Swing of Barn Close, 61 Lodge Hill Road, Lower Bourne, Farnham, Surrey GU10 3RD
Artiste means the performer(s) required for entertainment
Electronic means any written information received or sent by email
Force Majeure means unusual and unforeseeable circumstances beyond our control, resulting in events that we could not have avoided even if we had taken every possible care.  Such circumstances include (but are not limited to) war or threat of war, riot, civil strife, industrial dispute, unavoidable technical problems with transport, closure or congestion of airports, terrorist activity, natural or nuclear disaster, fire and adverse weather conditions.

Bookings

Simply Swing Is Responsible For:

• Arriving, setting up and performing as per times outlined on the booking form or subsequently negotiated with the Client
• Providing all instruments, microphones, cables, PA, lighting or any other equipment deemed necessary for each performance except where the Client has already arranged for equipment to be made available
• Ensuring the safety of all equipment used whilst on site
• Performing in a polite and professional manner whilst at the engagement
• Leaving the facilities as found on completion of the engagement
• Simply Swing has the right to interchange its personnel on any given performance so long as the standard of musicianship is not compromised
• Simply Swing will not be held responsible for any non-fulfilment of contracts due to Force Majeure

The Client Is Responsible For:

• Providing full details of the required performance including timings, venue details, contracts and special requirements
• Providing for adequate parking facilities for the artiste(s) vehicles. Where no legal parking is available, the client agrees to pay parking expenses
• Providing an appropriate and safe environment in which to perform, that will include a covered performance area on a dry, flat surface and with good access to loading/unloading facilities.  Typically, the band will require a 4m x 3m performance area.  This may vary depending on the number of performers
• Ensuring performers have access to suitable and secure changing facilities
• Ensuring adequate power supplies are available where appropriate.  Typically the band will require a minimum of 2 x 13 amp sockets.  Extension leads, cables and other equipment will be supplied
• Advising of any sound restrictions at the venue or any other restrictions which may affect the artistes' access or performance
• Providing soft drinks, a hot meal or buffet for each performer (where requested)
• Any other special requirements as requested by Simply Swing at the time of booking

Confirmation

This contract, reflecting the terms and conditions as agreed verbally or by email, shall be deemed accepted only when it is duly submitted and returned within 7 working days of the verbal or email confirmation.  You should keep a copy for your records. 

Cancellations & Postponements

• All deposits are non-refundable on completion of this contract by both parties
• Client cancellation 4-12 weeks prior to the performance date will render the Client liable to a payment of 50% of the agreed fee. 
• Client cancellation within 28 days of the performance date will render the Client liable to a payment of 100% of the agreed fee.
• Outstanding payments from bookings and cancellations will be referred to our legal department if not received within 28 days of the due date.
• If, due to Force Majeure, your event needs to be rescheduled, bookings must be rearranged prior to the performance date and the rescheduled date must be within a six month period from the originally booked performance.  If Simply Swing cannot reschedule due to lack of availability, a postponement will be treated as a cancellation. If your event cannot be rescheduled prior to the performance, the booking will be treated as a cancellation.
• Once the Artiste(s) has agreed to the performance either by email or in writing, the artiste(s) will be unable to cancel the booking for any reason other than those highlighted by 'Force Majeure'.

Commercial Rights

The "Artiste" and the "Client" hereby agree that the performance shall not be broadcast or recorded for commercial gain without the written agreement of both Parties hereto

Changes To Your Booking

For advice on amending a booking, please contact us on 0845 094 8693.  All amendments to the original booking form such as extended performance times or additional performers must be confirmed in writing.
